Terms of Use

1. General

These terms are an agreement between you and the Payda project, owner of the website playpayda.com ("we", "the site"). By starting a game or otherwise using the site you fully and unconditionally accept these terms and the Privacy Policy. If you do not agree, do not use the site.

The site is an entertainment service: an online board game. Playing is free; the only paid item is stars (section 6).

2. Who may play

The site is not intended for children under 13. If you are under 18, use the site with the permission of your parents or other legal guardians. By using the site you confirm that you meet these requirements. Where the law so provides, a minor's legal guardians are responsible for the minor's actions on the site.

3. Profile

• You can play without registering: a guest profile is created automatically and its access key is kept in your browser. If you clear the site data, access to the guest profile is lost and cannot be restored.
• Signing in to an account, with Google or with a code sent by e-mail, is optional. It keeps your profile and stars across devices.
• You are responsible for keeping access to your browser, your e-mail and your Google account safe. Everything done from your profile is treated as done by you.
• You must not hand over your profile or access to it to anyone else.
• We may delete guest profiles that have not been used for a long time.

4. Rules of conduct

On the site you must not:

• insult, threaten or harass other players, or incite hatred;
• use a nickname, image or messages that are obscene, unlawful or misleading, or impersonate another person;
• publish other people's personal data, advertising or spam;
• upload images you have no rights to, or images of other people without their consent;
• interfere with the site: break into it, flood it with requests, or use bugs or third-party programs to gain an advantage or stars;
• use automated programs or scripts to play, collect data from the site automatically, or tamper with the data exchanged between the browser and the server;
• copy, modify or distribute the site or its parts, or use them commercially, without our written permission;
• break the law or the rights of others.

We may, at our discretion and without prior notice, remove a nickname, image or message that breaks these rules, restrict or close the offender's access, delete the offender's profile and reset stars obtained through a violation. No compensation is paid. We are not obliged to check in advance what players post. Report a violation to support@playpayda.com.

5. Your content

Your nickname, uploaded image and messages remain yours. You grant us a free, non-exclusive right to store, reproduce and show them to other players, spectators and visitors of the site, to the extent the game needs it, for as long as they are posted, and in the records of finished games and in backups for the periods stated in the Privacy Policy.

You warrant that you have the right to use this content and that it does not break the law or the rights of others. You are responsible for the content you post.

6. Game money, stars, purchases and the "casino"

• Game money, properties, houses and other items exist only inside a game. They are parts of the game, not money and not property.
• Stars are in-game points for unlocking cosmetics: figures and dice. They can be earned by winning public games or bought. Stars and cosmetics give no advantage in the game.
• Game money and stars cannot be exchanged for real money, goods or services, transferred to another person or withdrawn from the site. No winnings are paid. Money for purchased stars is refunded only under the rules of this section.
• Game money, stars and cosmetics do not become your property: you only receive the right to use them on the site. We may change the number of stars, the prices of cosmetics and the rules for earning stars, and, to the extent the law allows, reset stars and cosmetics if these terms are broken. If we decide to close the site, we will announce it on the site in advance and stop selling stars at once.
• "Casino" spaces and cards are a game mechanic that uses only the game money of that game. The site does not organise or run gambling, betting or lotteries.

Buying stars

• Only people signed in to an account can buy stars. If you are under 18, buy only with the permission of your parents or other legal guardians.
• Stars are sold in packs. The number of stars, the price and the currency are shown before payment; tax, if charged, is shown on the payment page.
• Payment is taken by the Polar service (polar.sh) acting as the seller (Merchant of Record): it processes the payment, issues the receipt and handles taxes, and its own terms also apply on the payment page. You enter your card details on Polar's page; we do not receive them.
• Stars are added to your account once Polar confirms the payment, usually within a few minutes. If stars do not arrive or are lost because of an error on the site, write to support@playpayda.com and we will add them or refund the money.
• You can get a refund within 14 days of payment if the stars from that purchase have not been spent: write to support@playpayda.com from the address you sign in with. If some of the stars have been spent, a partial refund is possible; any refund removes the matching share of the purchased stars from your balance. Refunds are made through Polar to the original payment method.
• When a payment is refunded, including after a dispute with the bank, the purchased stars are removed. If they have already been spent, cosmetics unlocked with stars become unavailable until the star balance is no longer negative.

7. Rights to the site and third-party marks

The site's code, texts and original design, and the Payda name and logo, are protected by law and belong to the Payda project. All rights reserved. We grant you a personal, non-exclusive, non-transferable and revocable right to use the site to play for non-commercial purposes. Any other use of the site, or of the Payda name and logo, requires our written permission.

Third-party names and trademarks belong to their owners; Payda is not affiliated with or endorsed by them.

If you are a rights holder and believe that material on the site infringes your rights, write to support@playpayda.com: identify the material and confirm your rights. We will review the request and remove the material where necessary.

8. Warranties and liability

• The site is provided "as is" and "as available". We do not warrant that the site will work without interruption or errors, meet your expectations, or that games, profiles, stars and cosmetics will be preserved.
• We may at any time and without prior notice change the game, the rules of games and the design, carry out maintenance, and suspend or stop the site in whole or in part.
• We do not undertake to preserve game progress, a profile, stars or cosmetics, or to keep the site running without interruption; their loss, and interruptions and failures, are not a breach of these terms. We are not responsible for the actions and content of other players or for the operation of third-party services, networks, your browser or your device.
• To the extent the law allows, only actual damage is compensated; lost profit and indirect loss are not.
• We are not liable for a failure to perform caused by circumstances beyond our reasonable control: failures of service providers, network or power outages, attacks on the site, acts of public authorities, natural disasters.
• These terms do not limit the rights the law gives you as a consumer and that cannot be limited by contract, and do not exclude liability that cannot be excluded by law.

9. Your responsibility

You are responsible for your actions on the site and for the content you post. If you break these terms, the law or the rights of others, you undertake to compensate us for the resulting loss, including payments on third-party claims and the cost of defending them.

10. Third-party services

Sign-in with Google is provided by Google, and payment for stars by the Polar service, each under its own terms. The site may contain links to third-party resources; we are not responsible for their content or operation.

11. Stopping use

You can stop using the site at any time and ask us to delete your profile (see the Privacy Policy). We may restrict or close access for anyone who breaks these terms and delete their profile. Sections 5–9 and 13–15 continue to apply after you stop using the site.

12. Changes to the terms

We may update these terms. A new version takes effect when it is published on the site; its date is at the top of the document. By continuing to use the site after a change you accept the new version.

13. Governing law and disputes

These terms are governed by the law of the Republic of Kazakhstan. Before going to court you must send us a claim at support@playpayda.com; we will reply within 30 calendar days unless the law sets a shorter period. If we cannot agree, the dispute is heard by a court of the Republic of Kazakhstan at the location (residence) of the site's owner, except where the law mandatorily sets a different jurisdiction. The time limits for personal data requests are stated in the Privacy Policy.

14. Miscellaneous

If any provision of these terms is found invalid, the remaining provisions stay in force. If we do not exercise a right, that is not a waiver of it. Messages from us are treated as delivered when they are published on the site.

The document is available in Russian, Kazakh and English. If the versions differ, the Russian version applies.
